Terms of Service

These terms are the agreement between you and Baseflow Technology OÜ, registry code 17438321, Tallinn, Estonia (“we”), for using CutMeme. By creating an account you accept them. If you use CutMeme as a consumer, nothing here takes away the rights the consumer law of your country gives you.

Who can use it

You must be at least 16 years old. If you are under 18, you need your parent’s or guardian’s permission to buy a subscription. If you use CutMeme for a company, you confirm you may accept these terms for it.

The service

CutMeme lets you upload videos, cut people out of them with AI, put them on a new background, add captions and export the result. We keep improving it, so features may change. We aim to keep it available at all times but cannot promise that; we may pause it for maintenance or when a provider we depend on is down.

Your account

  • Give accurate information and keep your password safe. You are responsible for what happens in your account.
  • The free plan’s meme is one per person. Opening several accounts, or using throwaway email addresses, to get more is not allowed.
  • Do not share your account or sell access to it.

Your content

You keep all rights to the videos, images and captions you upload and to the videos you make. You give us only the permission we need to provide the service: to store, process and show your content to you, and to make the files you ask for. We do not publish your content, and we do not use it to train AI models.

Keep your own copies of what matters to you. We take care of your files, but storage can fail, and some files are deleted on purpose after the times in the Privacy Policy.

Acceptable use

Only upload content you have the right to use, and respect the people in it. In particular, do not use CutMeme to make or share content that:

  • is illegal or infringes someone else’s copyright, trademark or other rights,
  • shows a real person in a sexual, humiliating or harmful way without their consent, or shows minors in any sexual or harmful way,
  • impersonates someone or is meant to deceive people into thinking a fake event really happened,
  • harasses, threatens or incites hatred or violence against anyone,
  • you would need someone’s permission for and do not have it.

Also do not try to get around the plans’ limits, overload or attack the service, reach other people’s data, or copy the service by automated means.

You are responsible for what you publish elsewhere with videos made in CutMeme.

Reports and our decisions

We do not check content before it is processed. If you see content made or stored with CutMeme that you believe is illegal or breaks these terms, report it as described on the report page. We review reports with care and act on them.

If we remove your content or limit or suspend your account, we tell you what we did and why, unless the law forbids it or the content is clearly part of an attack on the service. You can contest our decision by replying to that message or writing to [email protected]; a person reviews it.

Plans and limits

The free plan includes one meme: a clip up to 10 seconds with one person, exported at 720p with a small mark in the corner.

Paid plans (Pro and Studio) give you, each month:

  • Memes: removing the background of one clip up to 15 seconds is one meme; a longer clip uses one for every started 15 seconds. Pro has 40 a month, Studio 150.
  • Fair-use limits that keep the service fast for everyone: time for picking people in the editor (Pro 100 minutes, Studio 270 minutes), exports including exporting again and from the library (Pro 150, Studio 540), and the size of your library of saved people (Pro 10 GB, Studio 50 GB).

The month starts on the day your subscription started, on yearly plans too. What you do not use does not carry over. Jobs that fail because of us do not count. The pricing page shows the current plans. We will not lower a limit during a period you have already paid for; we tell you at least 30 days before a lower limit applies to you.

Payments

Seller. Subscriptions are sold through Link, Stripe’s checkout, as the seller of record (“Sold through Link”). You pay Link, Link sends your receipts, and the terms Link shows at checkout apply to the payment itself. These terms apply to the service.

Price and renewal. Plans are monthly or yearly (a year costs ten months), paid in advance, and renew automatically at the end of each period until you cancel. Prices include tax. They are in euros (in the United States, in US dollars), and the checkout may show them in your currency at the day’s rate. Before a yearly renewal you receive a reminder.

Cancelling. Cancel at any time from Plan and billing in the app, or in your Link account. Your plan stays active until the end of the period you paid for and is not renewed.

Changing plans. Moving up starts at once; the difference for the rest of the period is added to your next payment. Moving down, or to a shorter period, starts when the current period ends.

Failed payments. If a renewal cannot be charged, your plan stays for three days. After that your account moves to the free plan until the payment goes through.

Price changes. We tell you at least 30 days before a new price applies to you. It applies from your next renewal; if you do not want it, cancel before then.

Right of withdrawal and refunds

If you are a consumer, you may withdraw from a new subscription within 14 days of buying it, without giving a reason. Write to [email protected] or use Link’s support.

Your paid plan starts as soon as you pay, because you ask for it to start at once. If you withdraw:

  • and have not used any memes of the plan yet, you get the full payment back;
  • if you have, you get the payment back minus the share you used, counted by memes: for example, after 4 of a month’s 40 memes you get 90% back.

We refund within 14 days of your message, to the way you paid. This applies to the first purchase of a subscription, not to its renewals; a renewal can always be cancelled before it happens. If the service does not work as promised, write to us and we will make it right or refund you. Your other rights under consumer law are not affected.

When your subscription ends

You move to the free plan. Your saved people and the videos you made on the paid plan stay for 90 days, so you can download them; we email you 30 and 7 days before they are deleted. If you subscribe again before then, nothing is deleted. A video you made on the free plan stays until you delete it.

Ending the agreement

You can delete your account at any time from the account page. That ends your subscription at once without a refund for the days left, and deletes your data as the Privacy Policy describes.

We may suspend or close an account that seriously or repeatedly breaks these terms, or when the law requires it. We tell you why, and you can contest it as described above. If we close your account without a fault of yours, we refund what you paid for the time left. We may also end the service as a whole with 60 days’ notice, refunding what you paid for the time after it ends.

Liability

We are fully liable for damage we cause on purpose or by gross negligence, for injury to life, body or health, and wherever the law does not allow a limit.

Otherwise, we are liable for slight negligence only when we break a duty essential to the service, and only for damage that was typical and foreseeable when you subscribed, up to what you paid us in the 12 months before the damage. We are not liable for lost profits or for content you did not keep a copy of, except as above.

You are liable to us for damage you cause by breaking these terms, including claims of others about content you uploaded.

Changes to these terms

We may change these terms when the service or the law changes. We tell you by email at least 30 days before a change that matters to you takes effect. If you do not agree, you can cancel before then; on a yearly plan we refund the unused full months.

Law and disputes

Estonian law applies. If you are a consumer, you also keep the protection of the mandatory law of the country where you live, and you may go to the courts there.

Please write to [email protected] first; most things are solved quickly. Consumers in the EU can also turn to the Estonian Consumer Disputes Committee (Tarbijavaidluste komisjon, www.ttja.ee) or the dispute resolution body of their own country.
